Ascendancy Recruitment Consulting - Terms Of Business

  • 1. Three months replacement policy
  • 1.1Our AdSearch and Advertised Selection services are covered by an undertaking to conduct a replacement assignment for the subject position at no consulting fee if the appointee fails to commence or resigns or is terminated from (other than due to redundancy) the position to which they were initially appointed within three calendar months from the commencement of employment with the client.
  • 1.2This undertaking is conditional on the client meeting our Terms of Business and Conditions of Engagement in the first instance. These terms include payment in full of invoice within seven days. The cost to the client of such a replacement assignment will be confined to out-of-pocket expenses such as advertising.
  • 1.3If a replacement for the subject position is not required by the client at the time of termination, Ascendancy Recruitment Consulting will credit the fee paid for the subject assignment to our next assignment(s) for that client.

  • 2. Confidentiality
  • 2.1Ascendancy Recruitment Consulting will not, without the agreement of the client, disclose to any unauthorised party confidential information entrusted to the consultant by the client.
  • 2.2Ascendancy Recruitment Consulting will not disclose any candidate’s details to any third party without the permission of the candidate.
  • 2.3All consultants’ reports regarding candidates are confidential and should not be shown to any unauthorised party. All reports that relate to candidates who are not appointed should be destroyed by the client as soon as practical, once the decision has been made not to appoint.
  • 2.4All discussions, negotiations and terms of business between Ascendancy Recruitment Consulting and the client will be regarded as “Commercial in Confidence” and will not be disclosed to any third party without written approval by the other party.

  • 3. Other undertakings
  • 3.1Ascendancy Recruitment Consulting will maintain a non-discrimination policy in respect of all candidates.

  • 4. Costs
  • 4.1If the client (or any associated entity) appoints any candidate referred by Ascendancy Recruitment Consulting within twelve months from the date of the referral, then the applicable fee will be charged.
  • 4.2If a candidate's report is disclosed to a third party by the client (or any representative of the client, authorised or otherwise) the client will be charged the applicable fee, as if the client had employed the candidate.
  • 4.3In the event that you require the assigned Ascendancy Recruitment Consulting consultant to travel internationally, interstate or to a regional centre to interview and/or appraise candidates, the relevant travel and accommodation charges will be invoiced to you at cost plus applicable GST.
  • 4.4       If a candidate is required to travel out of their home town for interviews, we will seek your approval for payment of the travel and accommodation charges involved.
  • 4.5       Out-of-pocket expenses incurred in the execution of the assignment (eg ISD/STD telephone calls, courier expenses, meeting room hire, etc) will be invoiced at cost plus applicable GST.
  • 4.6      The cost of print media advertising is at the current casual GST inclusive rate plus any applicable loadings for the particular publisher, unless otherwise agreed in writing by Ascendancy Recruitment Consulting, prior to the booking of the relevant advertising space. The cost of advertising will be billed direct to you by Ascendancy Recruitment Consulting upon lodgement of the advertisements. If requested we will provide you with a cutting of any print media advertisement(s) as proof of appearance.
  • 4.7      Fees paid for work in progress on an AdSearch Assignment or for completed Assignments are not refundable.

  • 5. Payment
  • 5.1The terms of payment for Ascendancy Recruitment Consulting services are seven days from the date of invoice.
  • 5.2The terms of payment for advertising costs are seven days from the date of invoice.
  • 5.3All Ascendancy Recruitment Consulting invoices must be paid in full within the specified terms to validate the placement guarantee.
  • 5.4Ascendancy Recruitment Consulting reserves the right to charge daily interest (calculated at a simple rate of 10% p.a.) on any invoiced amount remaining unpaid (in part or full) beyond the due date of payment.
